I/We apply for the credit facility above (Facility) offered by livi Bank Limited (livi). By submitting the application, I/We confirm and agree to the following matters:

The Facility is subject to its own terms and conditions, which I/We acknowledge that I/We have read and accepted.
livi has no obligation to approve my/our application.
All information I/we supply to livi is and I/we will be solely responsible for ensuring that it is true, correct, up-to-date, complete and not misleading. I/We authorize livi to make such enquiries as livi considers necessary to verify such information and for credit assessment purpose directly with the source of information or with any credit reference agency or by other means as livi considers appropriate. I/We will notify livi in writing as soon as reasonably practicable of any change of the information provided by me/us to livi.

(For applicant other than a limited company) I am not bankrupt or a discharged bankrupt, and that I have no intention to declare bankruptcy and I am not aware of any bankruptcy proceedings made or threatened against me/us.
(For applicant who is a limited company) No winding up or similar proceeding has ever been commenced or is currently pending against us and that the shareholder(s) of us has /have not resolved for our dissolution. All corporate and other actions have been taken to authorize our authorized signatory(ies) to sign this Application Form and any other documents and to do such acts and things as may be necessary for the purpose of this application for and on behalf of us.
All personal data relating to this application which may be collected by livi from time to time (including data obtained from any credit reference agency) may be used, transferred and disclosed for such purposes and to such persons (whether in or outside Hong Kong) in accordance with livi Conditions for Services and the Personal Information Collection Statement and such other document(s) issued under whatever name from time to time relating to its general policies on use, disclosure and transfer of personal data (PICS) issued and revised by livi from time to time, which I/we acknowledge that I/we have read and accepted. I/We am/are duly authorized by each of the individuals (including any director, shareholder, partner, sole proprietor, employee, agent, guarantor, security provider and other person whose information is set out in my/our application or is supplied or to be supplied to livi) (each, a Related Party) to confirm to livi on his/her behalf that: (i) he/she has received, read and understood the PICS and agrees to be bound by it; (ii) he/she consents to my/our supply of his/her personal data and other information to livi and agrees that livi may use, transfer and disclose his/her personal data and other information in accordance with the PICS; (iii) his/her personal data and other information supplied by me/us to livi are accurate in all material respects; and (iv) he/she is aware of the rights of access to and correction of his/her personal data under the Personal Data (Privacy) Ordinance (Privacy Ordinance). I/We have collected the personal data and other information of each Related Party by lawful means. On behalf of myself/ourselves and as the duly authorized agent of the Related Party, I/we confirm that all information collected by livi in relation to this application about me/us and Related Party may be: (I) used by livi in connection with matching procedures (as defined in the Privacy Ordinance) or other comparison procedures; (II) disclosed by livi by way of bank reference or in other manner to any financial institution with which I/we and/or Related Party have or propose to have dealings to enable such financial institution to conduct credit check on me/us and/or Related Party; (III) disclosed by livi to any bank, financial institution, participant, sub-participant or other company to whom livi wishes to transfer and / or assign all or part of its rights and obligations in relation to the transactions contemplated between the parties; and (IV) supplied by livi to credit reference agency and, in the event of my/our and/or Related Party’s default in repaying any indebtedness, to debt collection agency. I/We, on behalf of myself/ourselves and as the duly authorized agent of the Related Party, further authorize livi to contact (A) any credit reference agency for the purpose of accessing, collecting and using personal data and other information held by such credit reference agency about me/us and the Related Party, and (B) any employers (if applicable), banks, referees of me/us or the Related Party or any other source of information for the purpose of obtaining or exchanging any information, and to compare the information provided by me/us and/or the Related Party with other information collected by livi for the purposes of consideration of this application. livi is entitled to use the result of such comparison to take any action against me/us and/or the Related Party or which may be adverse to the interest of me/us and/or the Related Party. Any personal data and other information of me/us and/or the Related Party may be transferred to and/or held in another jurisdiction outside Hong Kong."
(For applicant or Related Party other than a limited company) In examining this application, livi may obtain from credit reference agency and consider a credit report on me/us and/or the Related Party. The credit report can be kept by livi in accordance with the Privacy Ordinance whether or not this application is approved, withdrawn or cancelled. On behalf of myself/ourselves and as the duly authorized agent of the Related Party, I/We understand that: (I) I/we and/or the Related Party can contact the credit reference agency and obtain a copy of the credit report under the Code of Practice on Consumer Credit Data (Code of Practice) issued by the Privacy Commissioner and, where appropriate, make a data correction request under the Privacy Ordinance; (II) under and in accordance with the terms of the Privacy Ordinance and the Code of Practice, I/we and/or the Related Party have the right to request to be informed which items of data are routinely disclosed to credit reference agencies or debt collection agencies, and be provided with further information to enable the making of an access or correction request to the relevant credit reference agency or debt collection agency; (III) this application and the personal data submitted will be passed to TransUnion and I/we and the Related Party agree to give consent to and authorize TU to transfer the consumer credit data of me/us and/or the Related Party which is held in the database of TU from time to time for the purpose of assessment of credit related risks of me/us and/or the Related Party in relation to this application; and (IV) TU may access and use of all information provided by me/us and/or the Related Party and the consumer credit data of me/us and/or the Related Party in the manner described above and such access and use shall not be made the basis for any complaint, claim, suit, demand or cause of action or other proceeding against TU and/or livi by me/us and/or the Related Party."
(For applicants or Related Party who is a limited company) livi will treat information relating to this application as confidential, but unless consent is prohibited by law, I/we, on behalf of myself/ourselves and as a duly authorized agent of the Related Party, consent to the transfer and disclosure by livi of any information relating to us and/or Related Party to and between livi’s holding companies, branches, subsidiaries, representative offices, affiliates, agents, credit reference agencies, debt collection agencies and any third parties (including any networks, exchanges and clearing houses) selected by any of livi or them (each a transferee), wherever situated, for confidential use (including for data processing, statistical, credit and risk analysis purposes). livi and any of the transferees may transfer and disclose any such information to any person as required by any law, court, regulator or legal process in Hong Kong or any relevant overseas jurisdictions.
I/We further agree to pay and reimburse livi and/or the related bodies on demand all costs and incidental expenses reasonably incurred in connection with this application. I/We hereby authorize livi to debit any of our accounts with livi (if any) with all sums due to livi in respect of this application.
I/We hereby consent to livi’s providing to any guarantor or security provider (the “Surety”) and/or to the solicitor acting for such Surety the following: (a) any financial information concerning me/us; (b) a copy of the contract and copies of the contracts from time to time evidencing the obligations to be guaranteed or secured or a summary thereof; (c) a copy of any formal demand for overdue payment which is sent to me/us after I/we have failed to settle an overdue amount following a customary reminder; and (d) from time to time on request by any Surety, a copy of the latest statement of account provided to me/us. For the purpose of releasing the information mentioned above, we as duly authorized agent of each of the Surety, agree that any information concerning such party can be released to other Surety(ies).
